Terms & Conditions

Last updated: 29 September 2026

These Terms & Conditions (“Terms”) are a legal agreement between you and NearPe (“we”, “us”, “our”) for the use of our website https://nearpe.in, our mobile application and our APIs (together, the “Platform”). This document is an electronic record under the Information Technology Act, 2000 and does not need a physical or digital signature. By registering, logging in or using the Platform, you agree to these Terms, our Privacy Policy and our Refund & Cancellation Policy. If you do not agree, please do not use the Platform.

1. Who can use the Platform

  • You must be at least 18 years old, resident in India and legally able to enter into a contract.
  • The Platform is meant for retailers, distributors, master distributors, white-label partners and API partners (“Members”) who use it to serve customers, and for individuals using the services for themselves.
  • You must give true, complete and current information when registering and during KYC, and keep it updated. We may refuse, suspend or close any account at our discretion, for example if KYC is incomplete or information is false.

2. Your account and security

  • You are responsible for everything done through your account. Keep your password, wallet PIN, OTPs and API keys secret and do not share them with anyone, including our staff.
  • Tell us immediately at the contact details below if you suspect unauthorised use. We are not responsible for losses caused by sharing your credentials or by devices you control.
  • One person or business may hold one account per role, unless we agree otherwise in writing.

3. Our services

Through the Platform you can use, subject to availability and your account type:

  • Mobile, DTH recharge and bill payments, processed through telecom / DTH operators and Bharat BillPay (BBPS) billers.
  • PAN card services: new PAN and correction applications through NSDL e-Gov / Protean and UTIITSL, via authorised service partners. We are a facilitator only; we are not a government body. Acceptance of an application and issue of the PAN are decided by the Income Tax Department and its agencies, not by us.
  • Verification services, such as PAN, bank account, GST and other identity or document checks, using data from third-party sources.
  • NSDL Payments Bank account opening, where you act as a Business Correspondent agent under the bank’s terms.
  • SMS OTP and API services for API partners.

Each service is provided by, or depends on, third parties (operators, billers, banks, government agencies and technology partners). We will do our best to complete every request, but we do not guarantee that a service will always be available, error-free or completed within a particular time, and we are not responsible for delays or failures caused by those third parties.

4. Wallet

  • Your wallet holds a prepaid balance that you add through our payment gateway or that your distributor transfers to you. It can be used only to pay for services on the Platform.
  • The wallet is not a bank account and earns no interest. The balance is not transferable except by the member-to-member transfers the Platform allows.
  • Charges for each service are shown before you confirm it and are debited from your wallet. Refunds of failed transactions are credited back to the wallet as described in our Refund & Cancellation Policy.
  • We may put a temporary hold on, or reverse, any credit or transaction that appears fraudulent, erroneous or unlawful, and may share information with banks and authorities to investigate it.

5. Charges, commissions and taxes

  • Service charges, onboarding / activation charges and your commission plan are shown in the Platform and may change from time to time. Changes apply only to transactions made after they take effect.
  • Commissions are earned only on successful transactions and are reversed if the transaction is later refunded or reversed.
  • GST, TDS and other taxes are charged or deducted as required by law.

6. Your responsibilities

  • Check all details (mobile / account number, operator, amount, applicant details) before confirming. Transactions made with wrong details you entered may not be reversible.
  • When you enter a customer’s personal data (for example for a PAN application or a verification), you must have the customer’s consent and use the result only for the purpose it was requested for.
  • Use the Platform only for lawful purposes. You must not:
    • use another person’s identity or documents without authority, or submit false information;
    • use the services for fraud, money laundering or any illegal activity;
    • try to hack, overload, copy or reverse-engineer the Platform or its APIs; or
    • resell or share your access except as your account type permits.
  • Retailers and partners who deal with customers must display correct prices and give customers proper receipts.

7. API partners

  • Keep your API key, token, PIN and password secret, whitelist your server IPs, and secure the callback URLs you give us.
  • You are responsible for every request made with your credentials, and for the customers and agents you onboard through the API.
  • We may change, rate-limit or suspend the APIs for maintenance, security or legal reasons, with notice where practical.

8. Suspension and termination

We may suspend or close your account, with or without notice, if you break these Terms, if required by law or a regulator or partner, or to protect users from fraud. You may close your account at any time through Delete Account. Pending transactions are completed or refunded first, and any remaining eligible wallet balance is refunded as per our Refund & Cancellation Policy.

9. Intellectual property

The Platform, its software, design, brand, logos and content belong to us or our licensors. You get a limited, personal, non-transferable right to use the Platform under these Terms. You may not copy, modify or distribute any part of it without our written permission.

10. Disclaimers and limitation of liability

  • The Platform is provided “as is” and “as available”. Verification results come from third-party sources, and we do not guarantee that they are accurate or complete.
  • To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for loss of profit, business or data.
  • Our total liability for any claim about a transaction is limited to the amount you paid us for that transaction.

11. Indemnity

You agree to indemnify us against any claim, loss or penalty arising from your breach of these Terms, your misuse of the Platform, or any data you submitted without proper consent or authority.

12. Governing law and disputes

These Terms are governed by the laws of India. Any dispute will first be attempted to be resolved through our Grievance Officer. If it is not resolved, it will be subject to the exclusive jurisdiction of the courts at the place of our registered office (NEARPOINT INDUSTRIES PRIVATE LIMITED Malopara, Chhabghati, Bazitpur, Aurangabad, Murshidabad, West Bengal, Pin Code. 742201).

13. Changes to these Terms
